it was not a suo moto notice case,an applicant have a registred a petition against extension of COAS.

  after that the applicant withdraw the case by submitting application and Chief Justice take this case as a suo moto notice.

    Yes, but it can not be considered as Suo Motu

According to law, it is not considered as a suo moto. If an applicant withdraw from his/her petition then the court has authority to whether withdraw case or review the case. The matter would be decided by court not an individual.
